Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BananaBond platform, available at bananabond.com (the “Service”), operated by the individual behind BananaBond (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms.
1.1 Eligibility
The Service is designed for students preparing for MATSEC SEC O-Level Chemistry examinations. You must be at least 13 years old to use the Service. If you are under 18, you confirm that your parent or guardian has consented to your use of the platform.
1.2 Account Registration
Account creation is managed by Clerk, a third-party authentication provider. You are responsible for maintaining the confidentiality of your login credentials. You must provide accurate information during registration. We reserve the right to suspend or terminate accounts that violate these Terms.
1.3 Permitted Use
You may use the Service solely for personal, non-commercial, educational purposes. You must not:
- Copy, reproduce, distribute, or republish any flashcard content from the platform
- Attempt to reverse-engineer, scrape, or extract data from the Service
- Share your account credentials with others
- Use the Service to generate or distribute content that is harmful, misleading, or infringing
- Circumvent any access controls or payment mechanisms
1.4 Intellectual Property & Copyright
All flashcard content on BananaBond — including questions, answers, explanations, and deck structure — is the original work of BananaBond and is protected under the Copyright Act (Chapter 415, Laws of Malta) and applicable European Union law. Community-generated and AI-generated content remains the property of its respective creators. You may not copy, reproduce, redistribute, resell, screenshot for redistribution, or otherwise exploit any content from the platform without prior written permission from BananaBond.
1.5 User-Uploaded Content and Copyright
BananaBond provides tools that allow users to upload notes and other materials for the purpose of generating personal study flashcards. Users are solely responsible for ensuring they have the right to upload any content they submit to the platform. By uploading content, you warrant that you own or have the necessary rights to use that material.
BananaBond accepts no liability for any copyright infringement arising from content uploaded by users. We act solely as a processing intermediary and do not moderate, store, or retain any uploaded files. Uploaded notes and documents are passed directly to our AI processing service for flashcard generation and are not saved to our servers, databases, or any third-party storage at any time.

1.6 Database Rights
The BananaBond flashcard database constitutes a protected database under the EU Database Directive (96/9/EC) as implemented in Maltese law. The extraction or reutilisation of substantial parts of the database — whether in a single act or through repeated and systematic acts — is strictly prohibited without prior written authorisation from BananaBond.
1.7 Licence Grant
Subject to these Terms and payment of any applicable fees, BananaBond grants you a limited, non-exclusive, non-transferable, revocable licence to access and use purchased content solely for your own personal study purposes. This licence does not permit you to sublicence, share, or otherwise make content available to any third party.
1.8 Subscription and Purchases
BananaBond offers both one-time deck purchases and a recurring LearnerPlus subscription. Payments are processed by Stripe. By making a purchase, you agree to Stripe's terms of service. Subscriptions renew automatically until cancelled. You may cancel at any time; access continues until the end of the paid billing period.
1.9 Availability and Changes
We do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue features at any time. We will endeavour to provide notice of material changes where reasonably practicable.
1.10 Limitation of Liability
To the fullest extent permitted by applicable law, BananaBond shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including reliance on flashcard content for examination purposes. Flashcard content is provided as a study aid and does not constitute a guarantee of examination outcomes.
1.11 Governing Law
These Terms are governed by the laws of Malta and, where applicable, the laws of the European Union. Any disputes shall be subject to the exclusive jurisdiction of the courts of Malta.
